You can have a valid marriage, even though one or both partners consents to marriage under duress. The law simply permits the coerced partner(s) to cancel the marriage obligation with an annulment. Something may be permitted by law without designing law to make it legally intended.<br /><br />That a valid marriage is invalidated by the petition of the coerced spouse is an accommodation of personal privacy. This does not mean that the institution of marriage can ever legally intend coercion.<br /><br />That a valid marriage is only invalidated after the petition of a spouse denied consummation is also an accommodation of marital privacy.
